The Code Of The Magi

The following is a piece of legislation agreed upon by the good King Thurmond II of Achareon, Kingdom of Wearyn, and The Institute Of The Magi, on the 32nd of Veyura, 245 Anno Minerva.  

The Code Of The Magi



We, The Representatives Of The Great Schools Of Achareon,
In Concert With Ruler Thurmond II And The Joint Kingdoms,
Hereby Make It Known We Ratify The Following Code And Consent To Submit All Mages Operating Under, At Behest And With The License Granted By The Institute Of The Magi.
The Code Will Take Effect Immediately Upon Its Signing And Will Apply In Its Entirety To All Mages Within The Realm, Whether Members Of The Institute, Its Former Members Or Non-Members. The Institute Commits To Educate Mages About Code Hereby Ratified And Hunt Down The Outlawed And Wanted Mages That Go Against It.


Chapter 1, General Regulations


1 § The Purpose Of The Law


This law shall specify the general use cases of magic which are, and which aren't, permitted or prohibited. Its goal is to ensure magic isn't used in such a way that it results in harm or danger to individuals, property, personal freedoms, personal inviolability or autonomy, except as defined within the Code.

The law applies to all mages and users of magic within Achareon, and will be enforced particularly within the joint kingdoms.


2 § Definitions


1) Magical Act
Any type of use of magical energy, whether divine or arcane in origin, inherent to one's race or other natural or supernatural capabilities, the manipulation or infusion of magical effects, or the operation of magical objects (wands, staffs, scrolls etc.)

2) Person
A creature, whether humanoid or beast, with sufficient level of intelligence to operate as an independent agent, and an ability to make its will known either verbally, telepathically, in written or any other form of explicit information transfer

3) Target
Any being, object or plane which is affected by a magical act

4) Settlement
Any area which falls under the active domain of a regional overlord, which is clearly defined and marked by signs, walls, fencing, or other such means, which houses the permanent or temporary domiciles of the subjects of the ruler. Settlements are not necessarily defined by their size, as settlements can range from citadels to towns to roadside inns.

  • Private personal houses, buildings, settlements or keeps located in the Dark Wilds do not automatically qualify, and are considered case by case. Typically these places operate under the same rules as the rest of the Dark Wilds, without centralized rule. These are however not safe havens for mages who are outlawed and harboring of such individuals even outside of governed settlements is a punishable crime.

5) License (of Magic)
A document obtained from The Hand of The Institute of the Magi, without which mages are not allowed to use magic within settlements. Licenses are only valid for the duration as shown on the stamp of approval. Licenses can be revoked if magic is used in a manner prohibited within the Code. Forging licenses is a punishable crime.

6) The Code
The Code of the Magi, a piece of legislation agreed to by The Institute and the regional rulers, under which all uses of magic within settlements is charged and evaluated, and which every mage is required to know and adhere to, whether current or former members of The Institute, or not.
 

Chapter 2, The Use Of Magic


3 § Punishment Practices


Any person found using magic in violation to the rules and regulations as laid out within this Code shall be tried and punished if found guilty. The punishment will be determined considering the severity of the infringement and the potential damages caused by the magical act. The punishment ranges from fines to jail time or, in cases where such punishments can not be seen as sufficient; or the violator can be shown to likely repeat the offenses or commit other similar offenses; or the action has resulted in purposeful, calculated and premeditated death of its targets, the death sentence.

  • If the severity of the magical act can be viewed equivalent to that which could've been accomplished by non-magical means, the sentence shall be in line with to the laws which govern these acts in general, but The Institute may impose further measures to ensure the offense won't repeat
  • If the magical act was carried out in self-defense or in defense of others, and if the measures used do not exceed those which can be viewed as reasonable considering the threat and the circumstances surrounding the moment of the attack, the use of magic is permitted.
  • If the measures (magic) used can be viewed as exaggerated, the caster may yet be forgiven, if the circumstances were such that the measures used were the only measures available to them, or it can be argued that it was reasonable to expect their use due to the imminent danger of the attack, its danger, its suddenness or the environment.

4 § Prohibited Magic

1) Magical acts that deny, remove, alter or inhibit the physical, intellectual or spiritual freedoms of persons or personal property are prohibited

  • Magical acts that alter the physical composition or appearance of a target with the intention to deceive, maim or delude a person are prohibited
  • Magical acts that alter the memories, thoughts or emotions of other persons with the intention to deceive, maim or delude a person are prohibited
  • Magical acts that fabricate objects or beings with the intent to deceive, maim or delude a person are prohibited
2) Magical acts of assault with the intent to maim or destroy a person or personal property are prohibited.

  • Magical acts of destruction or assault may be performed upon a target if performed on private property, permission is granted by the target or its owner, and due safety precautions are observed.
  • Magical acts of controlled demolition upon dwellings or other large property require a permit in order to be performed.
3) Magical acts of mending and restoration are prohibited if there is dissent or reasonable suspicion of dissent by a targeted person or personal property.

4) Magical acts of Necromancy are prohibited unless used to stabilize a dying target or protect the soul or remains of a dead being.

5 § Permitted Magic


1) Magical acts of translocation, either material or planar, are permitted upon willing targets as long as due safety precautions are observed at the location of both exit and appearance.

  • Summoning or translocating of beings into an area that they would not be permitted to enter is prohibited.
2) Magical acts for the purpose of spectacle or entertainment are permitted if due safety precautions are observed and they do not conflict with article 4. Such acts must remain within a determined area for the duration, and they must not create any undue disturbance in the area they are located.

3) All other magical acts are permitted unless the implications of use or secondary effects conflict with the above.

6 § Using Magic Within Settlements and Acquiring License


All mages operating within the borders of settlements are expected to acquire, carry and be able to present a valid license for the use of magic. Any use case of magic is subject to the limitations and prohibitions as described in the Code above. The use of magic without a valid license is a punishable act, unless it can be proven to have been necessary as stated in article 3. If a mage can not afford a license, they may be accepted into the settlement but are explicitly forbidden to use magic even as defined in article 5, and are subjected to monitoring for the duration of their stay.


Licenses are acquired from The Hand, an administrative agency of The Institute of the Magi. Unless otherwise specified, The Hand shall operate jointly within the premise of The Adventurer's Guild, in order to ensure new arrivals a quick access to acquire the license.
