The Demanded Trials of Innocence

In the Continent, many societies have adopted the use of the Demanded Trails of Innocence. These trials exist so that, if a jury or judge cannot decide on whether or not the defendant is guilty, the defendant can make one out of three demands. The demands themselves vary in severity depending on the crime committed. If the crime is light, such as thievery, then the demands will only got as far as being knocked to the ground or rendered unconsciousness. If the crime severe, such as murder, treason or a war crime, then the demands will go to the death. The demanded trails are split into two categories, depending on whether or not the defendant is noble born:   Noble Demanded Trails:
  • Trail by combat: The defendant can demand a trial in which they will face the champion of the prosecutor, and fight in single combat.
  • Trail by honor: More so for the nobles or ladies who lack the means to fight themselves, those in a trail by honor can chose a willing champion to fight for them. Because someone else is chosen, the defendant or champion can chose to yield or submit defeat during the bout.
  • Commoner Demanded Trails:
  • Trail by divine judgement: The defendant is placed in the middle of a circle of either paladins or cleric and struck with divine power. If the defendant is unharmed (for a light crime) or simply survives (for a more severe crime) they are innocent.
  • Trail by bloodshed: The most common trail, many supposed criminals are put into a fighting pit together, and will fight each other like gladiators to rove their innocence.
  • These Trails are not used by every society, or have some variations between countries, but have been the basis for many judgements since their invention centuries ago.
