Magic Item License Act of 988

Outline

1. As of the year 988 and until this act is abolished, all persons within Dinma are required to have a Magic Item License registered and distributed by the Dinmanese government to purchase, possess, and sell any magical items. Any figure of legal authority who identifies an individual in public possession of a magic item without the appropriate license reserves the right to confiscate said item as contraband.  
  • The possession of magical items is not punishable by law, and no agent of the law has the right to execute punishment outside of confiscation.
  • Under no circumstances will an individual or entity’s privately owned property be entered or intruded upon to search for these items without the explicit permission of the property owner.
  • Any individual or entity that has an item lawfully confiscated will receive a 3-month grace period to allow the time necessary for the application and receipt of a Magic Item License that would permit its possession.
  • The government considers all mentions of acquisition in this document to include the act of crafting any mentioned items, with the exception of those bound to the art of magical infusion.
 

Whitelist

2. All decrees regarding the possession of magical items within this act do not apply to the following whitelist of items. Note that this does not permit the purchase or sale of these items; a Magical Item License of the appropriate grade is still required in that regard. This list may be amended to add or remove items as seen fit by The Triad.

Grading

3. The grade of any given license will determine the items that an individual or entity may lawfully possess and acquire. All Dinmanese citizens reserve the right to submit an application for a Magic Item License of any grade through any facility officially recognized as government-owned property, such as a postal center or courthouse. Citizenship is not required to be considered eligible for a graded license, but non-citizens will not be able to actively submit a request for a Magical Item License; they must become registered through other means that will be discussed later in this document.  

Grade D

Anyone with official identification of their Dinmanese citizenship is automatically considered to have a Grade D Magic Item License, which will permit the lawful purchase or acquisition of any item in the whitelist above.  

Grade C

Anyone with this license is permitted to legally acquire and possess any magic item considered Common. This is typically issued to fledgling guild members and some VIPs.  

Grade B

Anyone with this license has the same permissions as one with Grade C, with the addition of legally acquiring and owning Uncommon magic items. This is typically issued to advanced guild members and city guards.  

Grade A

Anyone with this license has the same permissions as one with Grade B, with the addition of legally acquiring and owning Rare magic items. This is typically issued to Guildmasters and military officials.  

Grade S

Anyone with this license is permitted to legally acquire and possess any magic item despite its rarity or classification. This is currently reserved for exceptional individuals that The Triad deem worthy.  

Eligibility

4. Whether or not an individual receives authorization for the requested license depends on a variety of factors, such as whether or not the applicant’s occupation requires the use of a magic item or any criminal history associated with the applicant. Below is a list of pre-determined scenarios that could affect a citizen’s eligibility for a Magic Item License.  

Commendations

  • Those who are trained in the ways of artificery a magical infusion are encouraged to apply for a Grade C license after taking and passing a standardized test created by Professor Yoran Slyfang of Bright-River University. These tests are issued to all government facilities that accept MILA applications.
  • Those who find themselves doing consistent work for a guildmaster or government official outside of any formal occupation or membership may find themselves eligible for a higher grade of license.
  • Government officials from allied countries may be granted a temporary license befitting of their rank during their time in Dinma, usually with express permission from The Triad.
  • Anyone who has joined the Dinmanese military is automatically issued the licenses needed to equip themselves with the magical weapons and armor provided to them by their commanding officers.
  • Those of exceptional reputation regarding acts of heroism may find themselves eligible for a high-grade license, depending on the nature of that reputation.
 

Detractions

  • Those with a criminal history may have certain items, such as weapons and armor, blacklisted from their graded licenses where applicable, depending on the severity of their crimes.
  • Those who have not gone through the proper procedures to confirm or acquire their citizenship within Dinma may be asked to complete the process before applying for any licenses of Grade C and above.
  • Those who have submitted multiple false or invalid claims for a graded license may become temporarily barred from submitting additional applications for an indeterminate amount of time.
 

Exceptions

5. Those who find themselves in exceptional circumstances that may require the use of a magical item that isn’t included on the whitelist but cannot gain approval for the appropriate grade may be eligible for a License of Exception. This will allow the individual to lawfully acquire and possess one or more items outside of their current grade. Below is a list of pre-determined scenarios that could affect a citizen’s eligibility for a License of Exception.  
  • Those who are part of the Dinmanese Witness Protection Program are issued an Amulet of Proof Against Detection and Location, along with the appropriate LOE, upon entry.
  • Those in the delivery service may be eligible for an LOE permitting possession of a Bag of Holding and a Broom of Flying or similar method of transportation.
  • Those whose occupation involves a modicum of heavy lifting may be eligible for an LOE permitting possession of a pair of Gauntlets of Ogre Power.
  • Those whose occupation involves a greater-than-average amount of exploring within the wilderness, such as those who work for The Hunter's Guild, may be eligible for an LOE to possess a pair of Gloves of Swimming and Climbing.
  • Those without darkvision whose occupation involves spending a lot of time in the darkness, such as a miner, may be eligible for an LOE to possess a pair of Goggles of Night.
  • Those within the medical field will receive special licenses from the government that will permit the possession and restocks of certain potions and other times used exclusively for patient treatment.
  • Those who need to often stay in communication with certain individuals over long distances for the sake of their occupation may be eligible for an LOE to possess a pair of Sending Stones or a Sending Sphere.
  • If you possess a magical item that is considered a family heirloom, you may be eligible for an LOE depending on your family’s history, ancestry, and the nature of the item itself.
  Any number of exceptions not accounted for on this list may exist. If you feel as though you are eligible for an LOE despite your claim of eligibility remaining unlisted, or if you have suggestions on improving this list, please mail an official feedback form to Grand Judge Tarlon Sythora (provided through any local postal center).  

Vendors

6. Those who wish to legally sell magic items in Dinma must apply for a Magic Vendor License. The grade of these licenses matches those of the Magic Item Licenses that permit possession and acquisition, with the added benefit of permitting the sale of the magic items associated with that grade. The same restrictions and factors that account for the eligibility to acquire any particular grade of Magic Item License also apply to the same grade of Magic Vendor License.
