Contract for Entrance into the Order of the Wind Lord Notos, and it’s Associated Orders.
RECITALS
THIS AGREEMENT is made as of the ____ day of __________, _____ between the Monastic Order of the Wind Lord Notos, and it’s subordinate Orders, including any Orders recognised as member orders of the Enfurnaced League of Orders, ("hereinafter referred to as the Order") and _______________ ("hereinafter referred to as the Postulant")
WHEREAS The Postulant desires to obtain entrance into the Service of the Order, and
WHEREAS The Order desires the Postulant's immortal soul and other services during The Postulant's time on the material plane.
NOW, THEREFORE, in consideration of the promises below and other good and valuable consideration (the sufficiency and receipt of which are hereby acknowledged) the parties agree as follows:
THE POSTULANT’S OBLIGATIONS
1. The Postulant shall, upon his entry into the Order, transfer all right, title, and interest in his individual chattels and goods as well as his life to the Order.
2. The Postulant shall, during the time he remains in the Order, take all efforts to increase his physical strength, skill, experience, magical prowess, and any other characteristic that has or may have any positive impact on the quality of his service.
3. The Postulant shall take all reasonable efforts to secure the obligation and fealty of others for their use in furthering the goals of the Order.
a. To the extent the Postulant succeeds in binding others to the service of the Order, the Postulant shall ensure that the terms of any contracts entered into are no less favorable to The Order than the terms of this Agreement.
b. Should the Postulant fail to comply with Section 3(a) of this Agreement, Tthe Postulant shall be responsible for compensating the Order for any damages, direct or indirect, foreseeable or unforeseeable, arising as a result of that failure
4. The Postulant shall, at The Order's direction, take all efforts, reasonable or otherwise, to assist The Order and any agents, assigns, affiliates, worshipers, vassals, or minions thereof with any task required on the material plane.
5. The Postulant shall not, under any circumstances, reveal the existence of this contract or its terms to any other entity, mortal or immortal. Failure to abide by this term shall be considered a material breach of this Agreement and entitles the Order to the immediate excommunication and an issuing of a warrant for assassination of the Postulant, which may be undertaken by any means necessary.
6. Seven attempts are authorised in the assassination of the Postulant, failing all such attempts removes the Order from all obligations under this contract to pursue the life of the Postulant.
THE ORDER'S OBLIGATIONS
1. The Order shall immediately grant The Postulant provisional entry into the service of the order for 1 lunar month, this time is used to test and assess the Postulant’s suitability or not, for permanent entry into the service of the Order.
2. The Order shall not directly interfere with any effort by the Postulant to fulfill the Postulant's obligations under this agreement. The Postulant shall succeed or fail on their own meritorious efforts.
3. The Order shall not seek to prematurely terminate the Postulant's time in the Order, except as expressly contemplated by other provisions of this agreement.
4. The Order shall train, imbue, and empower the Postulant with powers as described in Schedule A.
TERMINATION
1. The Order may terminate this agreement at will, with no prior notice to the Postulant.
2. The Postulant has no right to terminate this agreement.
REPRESENTATIONS AND WARRANTIES
1. The Postulant's Representations and Warranties
a. The Postulant represents, warrants, and covenants that he has the full right, power, and authority to enter into this agreement.
b. The Postulant represents, warrants, and covenants that he currently owns the full right, title, and interest in his own life, free and clear of any security interests, liens, licenses, obligations, debts, slavery contracts, or other encumbrances.
c. The Postulant represents, warrants, and covenants that his body and the life expressed through it, is currently in merchantable condition, unharmed, and undamaged other than ordinary wear and tear.
d. The Postulant warrants that he shall compensate the Order for any damage to his body, other than ordinary wear and tear, sustained between the effective date of this Agreement and the time the Order takes on the services of the Posulant.
e. The Postulant agrees to hold the Order harmless for any injury to himself or others arising out of any use or misuse, foreseeable or otherwise, of the training, and powers granted by The Order, and to indemnify the Order for any claims by third parties arising out of the use or misuse of those same abilities and powers.
2. The Orders Representations and Warranties
a. The Order represents, warrants, and covenants that she has the full right, power, and authority to enter into this agreement.
b. THE ORDER MAKES NO OTHER REPRESENTATIONS AND EXTENDS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, ORAL OR IN WRITING, IN FACT OR ARISING BY OPERATION OF LAW OR OTHERWISE. RECIPEINT ASSUMES NO RESPONSIBILITIES WHATSOEVER, OTHER THAN AS SET FORTH EXPLICITYL IN THIS AGREEMENT.
c. IN NO EVENT WILL THE ORDER OR ANY OF ITS AGENTS, ASSIGNS, AFFILIATES,
WORSHIPPERS, VASSALS, OR MINIONS BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF THIS AGREEMENT.
ASSIGNMENT
1. The Postulant may not assign any rights or obligations under this agreement without express, written permission from The Order provided in advance.
2. The Postulant's obligations under this contract run with the Postulant's body and life and are not voided by resurrection, reanimation, polymorph, possession, or any other natural,supernatural,or magical effect, artifact, ritual, device, enchantment, or contrivance that may serve to temporarily alter or replace the Postulant's physical form or temporarily or permanently separate the Postulant's soul therefrom.
3. The Order may assign any right under this contract to any other entity, mortal or immortal, for any purpose, without the Postulant's consent.
MISCELLANEOUS
1. Any failure to enforce any term of this Agreement or require the performance of any obligation under this Agreement by the Order shall not prevent any subsequent enforcement of such term or obligation or be deemed a waiver of any subsequent breach. This section shall not apply to The Postulant.
2. Interpretation of this Agreement shall take place as though it was drafted by the Postulant and any ambiguity shall be strictly construed against The Postulant.
3. This Agreement shall be governed by the applicable laws of Atlantis.
4. Any proceeding to enforce any provision of this Agreement or seeking redress for breach thereof shall take place in Atlantis.
5. The Postulant shall be liable to fulfill his obligations under the contract despite any Force Majeure Event, including, but not limited to, acts of gods (or other deific-level entities of any alignment), war, riots, civil unrest, fire, floods, earthquakes, or other accidents. This section shall not apply to the Order.
