dID: 221.5.11425

Starfleet Academy

Judicial and Disciplinary Board

Overview

This document is to certify that today, on the 8th of Feburary 2365, the Starfleet Academy Judicial and Disciplinary Board did convene to try Incident #11425, Greggor v. Fox. The incident is summarized thusly:
Plaintiff claims:
  1. Defendent showed flagrant disrespect to senior officer
  2. Defendent malliciously malalligned Starfleet's reputation
  3. Defendent malliciously malalligned Defendent's reputation
  4. Defendent attempted to incite insubordination among fellow cadets
Plaintiff requests:
  1. Defendent to submit a written and verbal apology
  2. Defendent to serve punitive detention
  3. Defendent to be placed on active probation
Defendent claims:
  1. The document in question was not meant to be read
  2. No other cadet was shown the offending document
  3. While the document does explicitly refer to the defendent, the document is wholly complimentary

Decision

With testimony from both parties considered, it is the decision of the borad that the requested punitive actions (2) and (3) be dismissed immediately at no fault to defendent. Punitive action (1) shall be upheld. Defendent is hereby ordered to provide a written appology no later than 2 solar days from this order.

Rational

It is my opinion that while the document in question, a personal log submitted for a class assignment, does read as disrespectful, I can find no intentional malice behind the document. Starfleet Disciplinary Code 22.12 Section (A) directs that a minor act of disrespect, made privately, is to be settled by a private apology. As Cadet Fox is a first offender, and because the document was viewed exclusively by Professor Greggor, it is unconscionable to consider more radical behavior altering techniques at this time. It is unreasonable to conclude from the evidence and testimony that Cadet Fox mallaligned Starfleet or Professor Greggor, nor did she incite insubordination. In the future, it is recommended that Cadet Fox show more seriousness in all aspects of her studies. Additionally, Professor Greggor should refrain from wasting this court's time by filing extraneous charges to settle petty grudges.
