First Councillor

The First Councillor of Lavenna is the elected head of state and government of the The Communal Republics of Lavenna. He/she is elected through a vote in the Communal Assembly, and must maintain the confidence of both the people and the Assembly. The First Councillor is the chief defense minister of the Lavennic Defense Forces, and is given the authority to issue executive decrees, though they need to have these confirmed through a majority vote in their cabinet. Every year, a popular referendum is held. Should the referendum fail, Parliament must hold a vote of no confidence in their continued councilorship.

Requirements

A First Councilor must:

1. Be an elected member of the Communal Assembly
2. Be at least 25 years old
3. Win a majority of the votes of the Communal Assembly through instant runoff voting
4. Maintain the confidence of both the people and of the Communal Assembly during their term.

Duties

1. To defend and serve the communes and republics of Lavenna
2. To uphold and defend the universal rights of humanity and nature
3. To uphold and defend the Lavennic Constitution
4. To ensure humankind's harmonious coexistence with the natural environment

Grounds for Removal/Dismissal

Annual popular referendums are the primary mechanism for dismissing a First Councilor, and should they fail to recieve enough votes past a certain threshold, a vote of no confidence (simple majority) is then held in the Communal Assembly. Should this vote succeed, the First Councilor is removed from office. However, should this vote fail, the process will be moved to the National Directorate, who will hold another vote of no confidence (although this vote requires a larger margin of 2/3rds). Should this fail too, the chamber of delegates is then finally given the opportunity to have their own vote of no confidence (also 2/3rds). If any of these votes suceed, the First Councilor is removed from office.
The only time this system has been used was in 488 AGL after the ascension crisis of Seripha, where Miranti Karsto lost her 8th popular referendum following her decision to circumvent parliament and directly issue an executive decree to admit Seripha to the LFR. The subsequent vote of no confidence in the Communal Assembly succeeded, and she was then removed from office. Kelmar Harval was then elected as her successor.
Alternatively, if immediate action is required and there is no time to wait for an annual popular referendum, any councilor can propose removal from office, and should their party reach concensus, a vote is to be held by the Communal Assembly. If a 2/3rds majority votes in favor, the First Councilor is removed from office.
