Legal Information
Legal Definition
Inheritorships, while generally considered a family matter, are actually a legally defined role in every province. This is a separate process from general inheritance and is primarily used in instances where an amassed fortune or family business is involved and allows the owner to determine how their assets will be distributed for generations after their death.Setting Parameters
In order to create an Inheritorship, the current owner must set forth a contract with their local municipality determining who and how assets will be distributed. This could be a simple decision to pass the assets along to the oldest child or the first child to manifest and particular enmanity. It may also require an Inheritor to be the winner of some kind of contest or to be the first to complete a particular task.Breaking Inheritorship
Once an inheritorship is established, it cannot be easily undone. It requires both the current owner(s) and the Inheritor(s) to come to an agreement on the terms of release, which must then be approved by the municipal court in which the inheritorship was initially established. If the Inheritor is underage and their parent is the current owner, the Inheritor is generally assigned legal counsel to act on their behalf. In very rare instances, it is possible that the parameters set out by the Inheritorship cannot be met. In these instances, the assets are temporarily placed into a trust while the next of kin (which may or may not be of blood relation) work with the municipal court to come up with a suitable solution. Sometimes this may be as simple as handing the assets to the second-born child instead of the first, but depending on the parameters it may be far more complicated.Example of Inheritorship: Two Sisters Vineyards
A good example of a long-standing inheritorship is that of the Canmore family who owns and operates Two Sisters Vineyards in Hessen, Cesland. The original owners of the business, Melia Tansel nee Canmore and Justise Canmore, wanted to ensure that their hard work would not be squandered and that their legacy would be left in the hands of someone capable of carrying it on. Together they established a set of terms for the inheritorship.- There shall be TWO Inheritors in each generation
- The Inheritors of Two Sisters shall reside on the property during the entirety of the time from birth to enmanity manifestaion.
- The first child of each generation to manifest Power of Flora shall inherit the grounds and grape processing facilities.
- The first child of each generation to manifest Power of Composition shall inherit the winery and associated storage facilities.
- The Inheritors shall share ownership of the vineyard house.
- Inheritors are to be presented with their inheritance upon the desire of the previous Inheritor to relinquish control of the property or upon the previous Inheritor's death, whichever comes first.
- These parameters are to remain in effect until the cessation of both the vineyard and winery operations of Two Sisters by the Canmore family.
