Supreme Court

The Supreme Court is the judicial branch of the Federal Republic's government being the guardian of the constitution as well as the laws of the Republic and the highest court in the land. The decisions of the Supreme Court cannot be appealed and serve as case law for the entire justice system.

Structure

The federal judicial system is headed by the Registrar of the Republic who is appointed by the President of the Legislature from the candidate chosen by the Office of the Federal Civil Service. He is responsible for taking care of the administration of the federal judicial system, archiving the decisions of all the federal courts and for appointing new judges of all federal judicial as well as for designated the Chief Justice of the Supreme Court.

Supreme Court 

The Supreme Court is the Head of the federal judicial system and renders the final verdict for all cases that arrive there. It must not seek to apply the law or constitution and not try to interpret it. The Supreme Court has nine justices who are appointed for fifteen-year terms based on candidates provided by an independent commission to the Regsitrar of the Republic. The Supreme Court can be seized in the case of two situations. The first is when the Federal Court of Appeal accept to transfer a case to the Supreme Court and the second with the Registrar of the Republic seeking the opinion of the court on a particular matter. Whatever its verdict, it must be followed by all the actors concerned and the necessary changes must be put in place, including sometimes the invalidation of a law.

Federal Court

The Federal Court is the first instance of the federal judicial system and is empowered to express itself on all cases which directly affect federal jurisdiction or have been handled by an agency of the same level. Specialized tribunals or courts have however been created in particular areas to reduce the number of cases to be processed and ensure greater efficiency. Divisions of all its organizations with the same powers and objectives are present throughout the territory to cover it entirely and avoid too much centralization. All cases are sent to the Federal Court of Appeal if appealed and are subsequently sent to the Supreme Court if the appeal is accepted.

Commissions

There are two commissions that depend on the federal judicial system with essential purposes for the republican system, the commissioners of which are appointed by the Registrar of the Republic from candidates coming from the Office of the Federal Civil Service. The first is the Federal Parole Board must decide whether the inmate can be released from prisons after completing his minimum sentence. The criteria can be good behavior or the risk of reoffending and he is free to impose conditions on release. The second is the Federal Electoral Commission which must be responsible for the proper conduct of federal elections, verifying that no irregularities are present and that candidates meet the criteria to run for office.

Public Agenda

The aim of the Supreme Court is to enforce the constitution and the laws of the Republic in court decisions. These judgments also make jurisprudence on the lower courts and this one cannot render a decision in contradiction with an old decision of the Supreme Court.

Assets

The Supreme Court and other bodies of the federal judicial system sit in Shanghai on Earth, but many other buildings throughout the Republic accommodate these institutions. In particular those which accommodate the divisions of the Federal Court and the various specialized courts.
